Nefes — Terms of Service

These Terms of Service ("Terms") govern your use of the Nefes app and form an agreement between you and Ömer Faruk Coşkun ("we"). By downloading or using the app, you accept these Terms. If you do not agree, please do not use the app.

1. License

We grant you a non-exclusive, non-transferable license to use Nefes for your personal, non-commercial use. Because the app is distributed via the App Store, Apple's Standard Licensed Application End User License Agreement (Apple Standard EULA, https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies; where these Terms and the Apple EULA conflict, the app-specific terms here that are more favorable to you control.

2. Health & safety disclaimer (important)

Nefes is a general wellness app. It is not a medical device and not medical advice, and is not intended to diagnose, treat, cure, or prevent any disease. Breathing exercises are not a substitute for professional healthcare. Full text: Health Disclaimer. In an emergency, call your local emergency number (112 in Türkiye).

3. Acceptable use

You agree not to: reverse-engineer, copy, or resell the app; abuse or interfere with the service's integrity; or use it for any unlawful purpose.

4. Subscriptions & payments (Nefes Premium)

Nefes Premium is an auto-renewing subscription that unlocks certain content and features. The current price, period, and any free trial are shown on the in-app purchase screen and in the App Store. (Promo: "7-Day Free Trial".)
Payment is charged to your App Store / Apple ID account upon purchase confirmation. The subscription auto-renews unless cancelled at least 24 hours before the end of the current period; the renewal charge occurs within 24 hours prior to period end.
If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
Cancellation: manage or cancel anytime in iOS Settings > [your Apple ID] > Subscriptions. Cancellation takes effect at the end of the current billing period.
Restore: if you purchased before, use "Restore" in the app to restore your subscription.
Refunds: purchases are handled by Apple and refund requests are subject to Apple's policies (https://support.apple.com/HT204084). We cannot cancel or refund a subscription on Apple's behalf.

Subscription packaging and pricing strategy are not the subject of these Terms; only the legal terms above apply.

5. Intellectual property

The app, its content (voice guidance, text, design, the "Nefes" brand and logos), and software belong to us or our licensors and are protected by copyright and trademark law. No rights are transferred except the limited license in these Terms.

6. Your content

The journal notes and records you create in the app are stored only on your device; we do not access them and you retain ownership (see Privacy Policy).

7. Disclaimer of warranties

The app is provided "as is" and "as available". To the maximum extent permitted by law, we make no express or implied warranties, including of uninterrupted/error-free operation or fitness for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app. Your statutory consumer rights are unaffected.

9. Termination

Your license may end if you breach these Terms. You may stop using the app at any time by deleting it.

10. Apple App Store–specific terms

When you obtain the app from the App Store, you acknowledge:

These Terms are between you and us only, not Apple. We, not Apple, are responsible for the app.
Apple has no obligation to furnish maintenance or support for the app.
If the app fails to conform to any warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
We, not Apple, are responsible for addressing claims relating to the app, including product liability, legal compliance, and consumer protection claims.
In the event of a third-party intellectual property infringement claim, we will handle it.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Governing law

These Terms are governed by the laws of the Republic of Türkiye, and the courts of the Republic of Türkiye have jurisdiction over disputes. Mandatory consumer rights are reserved.

12. Changes

We may update these Terms; we will change the effective date and notify material changes. Continued use after a change means you accept the updated Terms.
